In temeiul art. 108 din Constituţia României, republicată,

Guvernul României adoptă prezenta hotărâre.

Articol unic. -In anexa la Hotărârea Guvernului nr. 437/2005 privind aprobarea Listei cu substanţele active autorizate pentru utilizare în produse de protecţie a plantelor pe teritoriul României, publicată în Monitorul Oficial al României, Partea I, nr. 446 din 26 mai 2005, cu modificările şi completările ulterioare, numărul curent 136 se modifică şi va avea următorul cuprins:

PARTEA A: Se pot omologa numai utilizările ca fungicid şi regulator de creştere a plantelor.

PARTEA B: Pentru implementarea principiilor uniforme, vor fi luate în considerare concluziile raportului de evaluare pentru metconazol şi, în special, Apendicele I şi II din acesta, aşa cum au fost finalizate în cadrul Comitetului Permanent pentru Lanţul Alimentar şi Sănătatea Animală, la 23 mai 2006. In această evaluare globală, Comisia Naţională de Omologare a Produselor de Protecţie a Plantelor trebuie să acorde o atenţie deosebită:

-     protejării organismelor acvatice, păsărilor şi mamiferelor. Dacă este cazul, condiţiile de omologare trebuie să includă măsuri de reducere a riscurilor;

- siguranţei operatorului. Dacă este cazul, condiţiile de omologare trebuie să includă măsuri de protecţie."

Prezenta hotărâre transpune Directiva Comisiei 2008/45/CE din 4 aprilie 2008 de modificare a Directivei Consiliului 91/414/CEE in ceea ce priveşte extinderea utilizării substanţei active metconazol, publicată în Jurnalul Oficial al Uniunii Europene (JOUE) seria L, nr. 94 din 5 aprilie 2008.
