HOTARARE   Nr. 1895 din  4 noiembrie 2004

pentru modificarea si completarea Hotararii Guvernului nr. 408/2004 privind organizarea si functionarea Ministerului Mediului si Gospodaririi Apelor

ACT EMIS DE: GUVERNUL ROMANIEI

ACT PUBLICAT IN: MONITORUL OFICIAL  NR. 1075 din 18 noiembrie 2004

    In temeiul art. 108 din Constitutia Romaniei, republicata,

    Guvernul Romaniei adopta prezenta hotarare.

    Art. 1
    Hotararea Guvernului nr. 408/2004 privind organizarea si functionarea Ministerului Mediului si Gospodaririi Apelor, publicata in Monitorul Oficial al Romaniei, Partea I, nr. 285 din 31 martie 2004, cu modificarile ulterioare, se modifica si se completeaza dupa cum urmeaza:
    1. Alineatul (4) al articolului 1 va avea urmatorul cuprins:
    "(4) Ministerul Mediului si Gospodaririi Apelor este desemnat ca Autoritate de management pentru programul operational sectorial pentru infrastructura de mediu si organism intermediar pentru proiectele de infrastructura de mediu finantate din Fondul de coeziune."
    2. La articolul 2, dupa litera e) se introduce o noua litera, litera f), cu urmatorul cuprins:
    "f) de coordonare a utilizarii asistentei financiare nerambursabile acordate Romaniei de Uniunea Europeana in domeniul mediului."
    3. La articolul 3 alineatul (1), dupa punctul 34 se introduc punctele 35 si 36, cu urmatorul cuprins:
    "35. programeaza, coordoneaza si monitorizeaza utilizarea asistentei financiare nerambursabile acordate Romaniei de Uniunea Europeana;
    36. colaboreaza cu consiliile judetene si locale la elaborarea programelor si proiectelor referitoare la dezvoltarea infrastructurii de mediu, in vederea realizarii politicii sectoriale din acest domeniu."
    4. Articolul 11 va avea urmatorul cuprins:
    "Art. 11
    (1) In cadrul Ministerului Mediului si Gospodaririi Apelor se organizeaza si functioneaza Directia generala pentru implementarea fondurilor europene, care va functiona cu 50 de posturi la sfarsitul anului 2004 si cu 100 de posturi la sfarsitul anului 2005.
    (2) Agentiile regionale pentru protectia mediului se desemneaza ca organisme intermediare pentru programul operational sectorial pentru infrastructura de mediu; in cadrul acestora se vor organiza la nivel de directie structurile necesare.
    (3) Organismul intermediar pentru proiectele de infrastructura de mediu finantate din Fondul de coeziune si organismele intermediare pentru programul operational sectorial pentru infrastructura de mediu vor indeplini atributiile delegate de catre Autoritatea de management pentru programul operational sectorial pentru infrastructura de mediu, stabilite prin acordul ambelor parti."
    5. Anexa nr. 1 "Structura organizatorica a Ministerului Mediului si Gospodaririi Apelor" se inlocuieste cu anexa care face parte integranta din prezenta hotarare.
    Art. 2
    Hotararea Guvernului nr. 408/2004 privind organizarea si functionarea Ministerului Mediului si Gospodaririi Apelor, publicata in Monitorul Oficial al Romaniei, Partea I, nr. 285 din 31 martie 2004, cu modificarile ulterioare, precum si cu modificarile si completarile aduse prin prezenta hotarare, se va republica in Monitorul Oficial al Romaniei, Partea I, dandu-se textelor o noua numerotare.
