ORDONANTA DE URGENTA   Nr. 67 din 29 decembrie 1998

privind restructurarea financiara a Bancii Romane de Comert Exterior - BANCOREX - S.A., in vederea privatizarii

    In temeiul prevederilor art. 114 alin. (4) din Constitutia Romaniei,

    Guvernul Romaniei emite urmatoarea ordonanta de urgenta:

    Art. 1
    (1) Se autorizeaza Agentia de Valorificare a Activelor Bancare sa preia la valoare bruta active neperformante din bilantul Bancii Romane de Comert Exterior - BANCOREX - S.A., in limita unei valori de 4.182.000.000 mii lei.
    (2) In schimbul activelor neperformante predate Banca Romana de Comert Exterior - BANCOREX - S.A. va primi un titlu de stat de valoare egala cu valoarea bruta a activelor transferate, negociabil, purtator de dobanda, scadent la data de 31 martie 1999.
    (3) Operatiunea se va evidentia in bilantul Bancii Romane de Comert Exterior - BANCOREX - S.A. la data de 31 decembrie 1998.
    Art. 2
    Dobanda aferenta acestui titlu se va calcula si se va plati la scadenta, la nivelul costului mediu al resurselor, din pasivul bilantului Bancii Romane de Comert Exterior - BANCOREX - S.A.
    Art. 3
    (1) Predarea efectiva a evidentelor activelor neperformante se va efectua, esalonat, pana la data de 31 martie 1999.
    (2) Pana la predarea efectiva, evidentele raman in custodia Bancii Romane de Comert Exterior - BANCOREX - S.A., care va declansa sau, dupa caz, va continua procedurile de recuperare a creantelor.
    (3) Sumele efectiv recuperate de Banca Romana de Comert Exterior - BANCOREX - S.A. in acest interval raman la dispozitia bancii si vor diminua corespunzator angajamentul statului fata de Banca Romana de Comert Exterior - BANCOREX - S.A.
