    In temeiul art. 9 alin. (6) si (7), al art. 11 alin. (2) lit. d) si e), al art. 56 alin. (1) si al art. 58 alin. (3) din Legea energiei electrice nr. 318/2003,
    avand in vedere referatul de aprobare prezentat de Departamentul preturi, tarife si analiza economica,
    in conformitate cu prevederile procesului-verbal al sedintei Comitetului de reglementare al Autoritatii Nationale de Reglementare in Domeniul Energiei din data de 29 octombrie 2004,

    presedintele Autoritatii Nationale de Reglementare in Domeniul Energiei emite urmatorul ordin:

    Art. 1
    (1) Zonele orare utilizate la aplicarea tarifului A33 sunt cele stabilite in anexa care face parte integranta din prezentul ordin.
    (2) Anexa nr. 2.1 la Ordinul presedintelui Autoritatii Nationale de Reglementare in Domeniul Energiei nr. 12/2004, publicat in Monitorul Oficial al Romaniei, Partea I, nr. 573 din 29 iunie 2004, se modifica si se inlocuieste cu anexa la prezentul ordin.
    Art. 2
    Pentru consumatorii declarati eligibili conform legii, care nu isi exercita dreptul de eligibilitate, se aplica tariful A33.
    Art. 3
    Filialele Societatii Comerciale de Distributie si Furnizare a Energiei Electrice "Electrica" - S.A. vor reprograma contoarele in cel mult 30 de zile de la intrarea in vigoare a prezentului ordin. Recalcularea marimilor de facturare in conditiile modificarii zonelor orare utilizate la tariful A33 pentru luna noiembrie 2004 se va efectua pe baza unei proceduri elaborate de Societatea Comerciala de Distributie si Furnizare a Energiei Electrice "Electrica" - S.A. si avizata de autoritatea competenta.
    Art. 4
    Consumatorii care se incadreaza in prevederile art. 2 si care nu au instalate contoare electronice care sa permita aplicarea tarifului A33 la intrarea in vigoare a prezentului ordin vor plati energia electrica la tipul de tarif specificat in contract, cel mult 60 de zile de la intrarea in vigoare a prezentului ordin.
    Art. 5
    Filialele Societatii Comerciale de Distributie si Furnizare a Energiei Electrice "Electrica" - S.A. vor aduce la cunostinta consumatorilor care se incadreaza la art. 2 consecintele aplicarii prevederilor prezentului ordin, in termen de 10 zile de la data publicarii in Monitorul Oficial al Romaniei, Partea I.
    Art. 6
    Departamentul preturi, tarife si analiza economica din cadrul Autoritatii Nationale de Reglementare in Domeniul Energiei si furnizarii consumatorilor captivi vor asigura ducerea la indeplinire a prevederilor prezentului ordin.
