clasificarea calitatii apelor de suprafata

In temeiul prevederilor art. 110 din Legea apelor nr. 107/1996 si ale art.
7 din Hotararea Guvernului nr. 17/2001 privind organizarea si functionarea
Ministerului Apelor si Protectiei Mediului, cu modificarile ulterioare,
ministrul apelor si protectiei mediului emite urmatorul ordin:
Art. 1
Se aproba Normativul privind obiectivele de referinta pentru clasificarea
calitatii apelor de suprafata, prevazut in anexa care face parte integranta din
prezentul ordin.
Art. 2
Prevederile normativului prevazut la art. 1 se aplica la toate apele de
suprafata, cu exceptia apelor cu salinitate ridicata, inlocuind STAS 4706/88
"Ape de suprafata - Categorii si conditii tehnice de calitate".
Art. 3
Prezentul ordin intra in vigoare la 90 de zile de la data publicarii lui in
Monitorul Oficial al Romaniei, Partea I.

ANEXA 1
NORMATIV
privind obiectivele de referinta pentru clasificarea calitatii apelor de
suprafata
I. Dispozitii generale
Art. 1
(1) In scopul protectiei impotriva oricarei forme de poluare si de refacere
a calitatii apelor, clasificarea calitatii apelor se poate face in conditiile
prevederilor Legii apelor nr. 107/1996, cu modificarile ulterioare, si cu
respectarea prezentelor obiective de referinta.
(2) Obiectivele de referinta urmarite prin clasificarea calitatii apei au
in vedere urmatoarele:
a) abordarea integrata a evaluarii calitatii apei din punct de vedere
chimic, biologic si microbiologic;
b) coroborarea datelor de calitate a apei cu cele specifice sedimentelor;
c) armonizarea cu practica de la nivelul Uniunii Europene in domeniul
protectiei calitatii apelor de suprafata curgatoare;
d) asigurarea conditiilor de implementare a Directivei-cadru a apei;
e) incadrarea in metodologia adoptata in activitatea de monitoring a
Retelei transnationale de monitoring pentru bazinul hidrografic al Dunarii din
cadrul Conventiei privind protectia fluviului Dunarea.
(3) In cadrul prezentei clasificari a calitatii apei obiectivele de
referinta corespund valorilor corespunzatoare clasei a II-a de calitate si
reprezinta nivelurile ce urmeaza sa fie atinse pe plan national si regional
intr-o strategie pe termen mediu.
(4) Prezenta clasificare a calitatii apelor de suprafata inlocuieste
prevederile STAS 4706/88 "Ape de suprafata - Categorii si conditii tehnice
de calitate".
Art. 2
(1) Valorile limita precizate pentru fiecare clasa prevazuta in tabelul nr.
1 corespund limitei maxime admisibile pentru respectiva clasa de calitate.
(2) Clasa I. Limitele maxime admisibile reflecta conditiile naturale de
referinta sau concentratiile de fond. In situatia substantelor toxice
(sintetice) se adopta limita de detectie a metodei de analiza sau pragul minim
posibil de interes in activitatea de monitoring. In cazul substantelor de
provenienta naturala, inclusiv metale grele, conditia de referinta se refera la
fondul natural care se stabileste in cadrul bazinului hidrografic, pentru
fiecare sectiune de referinta din cadrul retelei bazinale de monitoring.
Sectiunile de referinta corespund acelor amplasamente la care influenta
antropica este sub 10% .
(3) Clasa a II-a. Limitele corespunzatoare acestei clase corespund
valorilor-tinta (obiective de referinta) si reflecta conditia de calitate
pentru protectia ecosistemelor acvatice. In cazul altor substante toxice,
valorile-tinta se stabilesc in baza evaluarii de risc.
(4) Clasele III - IV. Valorile limita corespunzatoare acestor clase sunt de
2 - 5 ori mai mari decat cele ale obiectivelor de referinta si reflecta
ponderea influentei antropice.
(5) Substante specifice. In cazul metalelor valorile limita se refera atat
la concentratia totala a unui metal (proba de apa nefiltrata si suspensie), cat
si la cea sub forma dizolvata. Determinarea continutului de metale dizolvate
implica o filtrare prealabila a probei.
(6) Convertirea datelor de calitate a apelor de suprafata din STAS 4706/88
la sistemul prezentului normativ se realizeaza pe baza coeficientilor de
echivalare prevazuti in tabelul nr. 2.
Art. 3
Evaluarea incadrarii in clasele de calitate in scopul stabilirii calitatii
apei se face din punct de vedere chimic, biologic si microbiologic. Pentru
probe lunare (12/an) se considera valoarea corespunzatoare la 90% asigurare, cu
exceptia oxigenului dizolvat la care se considera 10% asigurare.
Art. 4
Radioactivitatea trebuie sa corespunda reglementarilor in vigoare.
II. Dispozitii finale
Art. 5
Metodele de prelevare, transport si analiza utilizate pentru determinarea
cantitativa a indicatorilor de calitate prevazuti in tabelul nr. 1 sunt cele
prevazute de standardele in vigoare.
Art. 6
Prezentul normativ constituie un instrument de lucru pentru autoritatile de
gospodarire a apelor si de protectie a mediului in activitatea de evaluare
calitativa a resurselor de apa.
