privind modificarea si completarea articolului 189 din Codul penal

    Consiliul Provizoriu de Uniune Nationala decreteaza:

    ARTICOL UNIC
    Articolul 189 din Codul penal va avea urmatorul cuprins:
    "Art. 189
    Lipsirea de libertate a unei persoane in mod ilegal se pedepseste cu inchisoare de la 6 luni la 3 ani.
    In cazul in care fapta este savirsita prin simularea de calitati oficiale, prin rapire, de o persoana inarmata, de doua sau mai multe persoane impreuna, sau daca in schimbul eliberarii se cere un folos material sau orice alt avantaj, precum si in cazul in care victima este minora sau este supusa unor suferinte, ori sanatatea sau viata ii sint puse in pericol, pedeapsa este inchisoarea de la 2 la 7 ani.
    Daca pentru eliberarea persoanei se cere, in orice mod, ca statul, o persoana juridica, o organizatie internationala interguvernamentala sau un grup de persoane sa indeplineasca sau sa nu indeplineasca un anumit act, pedeapsa este inchisoarea de la 5 la 15 ani.
    Daca fapta a avut ca urmare moartea victimei, pedeapsa este inchisoarea de la 10 la 20 ani.
    Tentativa faptelor prevazute in alin. 1 - 3 se pedepseste.
    Constituie tentativa si producerea sau procurarea mijloacelor, a instrumentelor sau luarea de masuri in vederea comiterii faptei prevazute in alin. 3."
