pentru stabilirea modelului cererii de inregistrare si al certificatului de inregistrare in registrul comertului

    In temeiul art. 108 din Constitutie, republicata, si al art. 3 alin. (13) din Ordonanta de urgenta a Guvernului nr. 76/2001 privind simplificarea unor formalitati administrative pentru inregistrarea si autorizarea functionarii comerciantilor, republicata, cu modificarile si completarile ulterioare,

    Guvernul Romaniei adopta prezenta hotarare.

    Art. 1
    (1) Se aproba modelul cererii de inregistrare a persoanelor juridice supuse obligatiei de inregistrare in registrul comertului, prevazut in anexa A.
    (2) Se aproba modelul cererii de inregistrare in registrul comertului a persoanelor fizice si asociatiilor familiale, prevazut in anexa B.
    (3) Se aproba modelul cererii pentru obtinerea autorizarii functionarii, prevazut in anexa C.
    (4) Se aproba modelul formularului "Declaratie pe propria raspundere" din care rezulta ca la sediul social/secundar nu se desfasoara activitatile prevazute in obiectul de activitate declarat, prevazut in anexa D.
    Art. 2
    (1) Se aproba modelul certificatului de inregistrare a comerciantului, prevazut in anexa E.
    (2) Se aproba modelul formularului care devine anexa la certificatul de inregistrare, prevazut in anexa F.
    Art. 3
    Anexele A - F*) fac parte integranta din prezenta hotarare.

    *) Anexele A - F sunt reproduse in facsimil.

    Art. 4
    Ghidul si aplicatia informatica de completare a cererii de inregistrare vor fi elaborate de Oficiul National al Registrului Comertului si vor fi puse la dispozitie solicitantilor.
    Art. 5
    Prezenta hotarare intra in vigoare la data de 1 iulie 2004.
    Art. 6
    Pe data intrarii in vigoare a prezentei hotarari se abroga Hotararea Guvernului nr. 1.047/2003 pentru stabilirea modelului si continutului cererii de inregistrare si ale certificatului de inregistrare in registrul comertului, publicata in Monitorul Oficial al Romaniei, Partea I, nr. 646 din 11 septembrie 2003.
